USEPA New Effluent Limitations for Discharges from Construction and Development Sites
February 2010 - The U.S. Environmental Protection Agency (USEPA) adopted new effluent limitations guidelines (ELGs) and new source performance standards (NSPS) to control the discharge of pollutants from construction and development sites. This regulation became effective February 1, 2010.

New Jersey "Permit Extension Act of 2008" Extended
January 2010 - As one of his last acts before leaving office on January 18th, former Governor Corzine signed an amendment bill (A4347) to the "Permit Extension
Act of 2008," which extends the expiration dates of many State, County and Municipal development permits and approvals until December 31, 2012.

Breaking News - NJ Stimulus Bill Signed
July 2009 - Today Governor Jon Corzine signed The New Jersey Economic Stimulus Act. Among other economic amendments, this legislation temporarily suspends the Statewide Non-Residential Development Fee Act, aka "the Developer's Fee," which had been in effect since July 17, 2008.

NJDEP Water Quality Management Plans - July Update
July 2008 - The NJDEP has been working with counties to update the regional Water Quality Management Plans (WQMPs) and associated Wastewater Management Plans (WMPs) over the past year by remapping appropriate sewer sewice areas (SSAs). In response to the major updates to the WQMP Rules (N.J.A.C. 7:l5) adopted in July 2008, the target set forth in the regulations was to have revisions to the WMPs completed by April of 2009. These mapping updates have not been completed or even yet been made available for public comment for most of New Jersey.

NJDEP Water Quality Management Plans - March
March 2008 - The NJDEP has been working with counties to update the regional Water Quality Management Plans (WQMPs) and associated Wastewater Management Plans (WMPs). In response to the major updates to the Water Quality Management Planning Rules (N.J.A.C. 7:15) adopted in July 2008, the target is to have revised Wastewater Management Plans completed by April of 2009. These updated WMPs will show revised Sewer Service Areas (SSA) that is based on development constraints such as critical areas, wetlands and other sensitive land uses. The WMPs will also address the allocation of sanitary flow to specific properties in the SSAs areas based on land use. The NJDEP is also suggesting modifications to local zoning to address sewer service limitations.

What are the new NJDEP Public Notification Rules?
October 2008 - On September 2, 2008, the NJDEP implemented new public notification and outreach requirements for the Site Remediation Program to improve communication among those performing site remediations, the government, and the community. These rules require remediating parties to notify the public of specific remedial activities.

New Jersey Enacts Permit Extension Act - September 2008
October 2008 - New Jersey has enacted the "Permit Extension Act of 2008" that automatically extends the expiration date of most State, county and municipal development permits/approvals until July 1,2010. New Jersey Governor Corzine signed the bill on September 6, which took effect immediately. For permits/approvals with expiration dates from January 1, 2007 through July 1, 2010, the new expiration date is extended until July 1, 2010, when the permit term starts again. Permit extension will not be allowed beyond December 31, 2010 under this Act.
